It might be difficult to focus on the legal aspect of infidelity when you are dealing with the vast range of emotions that come with being betrayed by someone you loved, trusted, and believed you would spend the rest of your life with. When you discover that your partner has cheated on you, you may feel as if your world is crumbling around you. You may experience sadness, anger, depression, hurt, vengeance, or all of the above.
But that said, those who disturbs the marital harmony of others can be imprisoned or fined by the Syariah Court.
This means if there is a third person involved which includes the lover of the wife or husband, their families.
The offence is placed under ENACTMENT NO. 11 OF 2013 SYARIAH CRIMINAL OFFENCES ENACTMENT 2013 PART V – MISCELLANEOUS OFFENCES
It states that:
Any person who disturbs the marriage of another person in any manner and influences him or her to neglect his or her existing marital duties commits an offence and shall, on conviction, be liable to a fine not exceeding three thousand ringgit or to imprisonment for a term not exceeding two years or to both, and the Court may order the man or woman to return to his wife or her husband.
Probably there are still many out there who do not know about this particular law.
So, to clarify here, if there is a third person who tries to disrupt your household, as a husband/wife/sibling/friend/colleague/neighbour/acquaintance, you need to immediately go to court and inform this.
Here are some ways for you to make a complaint if you become a victim.
If you are a victim of a third party and want to make a complaint, you can submit it through the following steps:
- Make a complaint at the Enforcement and Prosecution Unit, the nearest state Islamic religious department
- Explain the form of the disorder or the couple’s relationship with a third person and its effect on the household
- Submit strong evidence in the form of documents or witnesses about third party harassment
- Complaints made by the victim will be investigated in detail by the Enforcement Officer and if there is evidence of the case will be prosecuted in the Syariah Court
- If convicted, the third person will be subject to the punishment prescribed in the relevant law
